  • Essay / Divorce in the United States - 464

As we approach the end of the millennium, it has become easier to escape a broken marriage. In the United States, many divorce laws allow for a faster processing time. These laws, often referred to as “no-fault,” grant divorce to a couple even if only one spouse requests it. Marriages can be dissolved easily and for little or no reason. Laws including this no-fault policy should absolutely not be enforced. The no-fault attitude toward divorce encourages casual actions in marriages. Studies show that divorce rates have increased by 15 to 25 percent due to no-fault divorce laws. Facilitating divorces can diminish the quality of a marriage. Typically, all marriages go through dark times, causing one partner to often think of comfort through divorce. Instead of resolving issues in a healthy manner, divorce under no-fault laws is quickly used to provide an escape. The breakdown of a family can have many impacts on the less involved individual members. Children involved in divorce are often the most affected victims of divorce. Children of divorced parents often feel neglected by the parent who chose to move, unloved and often overwhelmed with feelings of guilt. Poverty rates among single-parent households are alarming and are often the result of divorce. With all these factors added together, divorce is a dangerous and life-changing event in a child's psyche. Recently, with no-fault laws, it has become easier to dissolve a marriage for any reason or no reason. In the past, both divorces and marriages had to occur in the form of an agreement or liability contract. However, thanks to no-fault laws, marriages can be dissolved by the will of only one spouse. Many believe that courts should treat marriages like any other contract and therefore a divorce should be considered a violation of a legal agreement. If courts treated business contracts like they treated marriages, and systematically favored the party who wished to walk away, the direct result would be the collapse or decline of the economy. In conclusion, the lax divorce laws in our country contribute to the moral decadence of our society and should not be imposed.
