One of the biggest flaws would be that it would be difficult to enforce such a law. There should be a way to monitor each household to see if spankings are taking place. However, this is not realistic. No one checks houses for meth or domestic violence unless there is suspicion. Chances are they won't check for spanking either. And to what extent would the law be enforced? What would be the consequences of breaking the law? If you gave your child a light slap on the hand, would it be taken away? Questions like these are important. If the goal is to do what's best for the child, then taking them away from their parents for something harmless is contradictory. Research shows that when children are removed from their homes, it has as many psychological effects as the abuse itself. Children who are about to be placed in foster care do better if they are allowed to stay with their family. The problem is finding an effective way to enforce the law. Another way to prevent parents from turning spanking into violence is to require new parents to take an information course. It can take place in the hospital and just before the parents bring the baby home for the first time to class. There, an expert can teach them the difference between child abuse and spanking.
