    The Lake Sturgeon is listed as threatened and is protected in New York State as an endangered and threatened fish and wildlife species ; Species of special concern; Incidental Take Permit Regulations of New York State Conservation Regulations, Chapter 1, Part 182 (Part, nd). This regulation gives the State the ability to list New York native species as threatened or endangered in the State and its waters for multiple reasons. If the species is listed as threatened or endangered by the federal government, through the Department of the Interior, it will be listed on the state list. The following are reasons that could result in a species being listed in New York, the population is unable to self-sustain due to depleted population size, the total breeding adult population is sufficient to self-sustain, the species is listed as threatened or endangered. by any adjacent state or is a candidate species under the federal Endangered Species Act (ESA), the species has declined non-cyclically throughout much of its natural range, changes in the habitat or range of the species threatens its survival, overexploitation of the species for any purpose, disease, pollution, predation or competition threatens the survival, existence and adequacy of current regulations, geographical restrictions, the species is very sensitive to changes in the environment or other natural or human factors that affect the survival of the species (Part nd). Thanks to this regulation, the recovery of a species may be facilitated and other actions aimed at threatening a species are prohibited (part nd).
