Background information: After the Watergate scandal, a man named Leon Jaworski, who was charged with leading the investigation, obtained a subpoena. who ordered Nixon to relinquish the tapes and documents related to the meetings. Nixon claimed he had absolute executive privilege to protect the communications and released only some that were edited. The Supreme Court finally asked him to disclose them in full. Opinion: The Court ruled that President Nixon must release the tapes. Chief Justice Burger said absolute and unqualified privilege would undermine the judiciary's primary constitutional obligation to do justice in criminal prosecutions. The Court also held that limited executive privilege existed in areas of military or diplomatic affairs, but gave preference to the requirements of due process in the fair administration of justice.15.
