  • Essay / The Nautical Pact between Albania and Greece - 2466

The delimitation of the maritime border and the continental shelf is one of the most complicated and delicate issues of Albania. It is linked to historical affairs, Albanian heritage, economic development, international relations and the exploitation of our maritime natural resources. This delimitation has a great influence on security and international politics between the states concerned and, above all, on the security and prosperity of the region. My research will focus on two important, interrelated topics. I will discuss the “Delimitation of the Maritime Boundary and Continental Shelf” pact between Albania and Greece, an agreement which was later revoked by the Constitutional Court of Albania, as it was subject to an investigation and proved the incorrect division of the maritime boundary based on the “equidistant” principle. After that, I will confront the injustice done to Albania, reflected in the international law of the law of the sea. This article will argue in favor of the decision of the Albanian Constitutional Court to reject the nautical pact between Greece and the Albania as the most reasonable and fair decision, because it is directly related not only to geographical and legal reasons, based on the United Nations Convention. on the law of the sea (1982), but also on economic and tourism issues. The “secret negotiation” that took place between Albania and Greece consisted of ceding up to 225 square kilometers of the Albanian maritime zone to Greece. Albania faced the damage caused by the unfair division of the median line definition, as the negotiations were not based on the UNCLOS-82 convention. The convention recommends the application of the impartial principle in cases such as the Excl...... middle of paper ......th initiative of a new pact between our countries. Additionally, both countries must consider the importance of how best for both countries to protect their respective interests. Second, the rationale for negotiations must be based on international conventions on the law of the sea. But, as the expression goes: "Veritas Filia Temporis" (Truth is the daughter of time), a new pact between Albania and Greece is something that should be left to time. February 10).
